Welcome to www.maggyelias.com (the "Site"), operated by Lovy Elias Ministries Inc., also referred to in these Terms as "Maggy Elias," "we," "us," or "our." These Terms of Use ("Terms") govern your access to and use of the Site, including any content, functionality, products, memberships, courses, and services offered on or through it.

Please read these Terms carefully. By accessing or using the Site, creating an account, or making a purchase, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make purchases or enter into agreements on the Site. By using the Site, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding contract. Minors may use the Site only with the involvement and consent of a parent or legal guardian.

3. Products, Memberships, and Courses

The Site offers a range of offerings, which may include:

  • Physical products and clothing collections

  • Memberships and subscriptions

  • Online courses and digital content

We strive to display products, descriptions, and pricing accurately. However, we do not warrant that descriptions, colors, images, pricing, or other content are complete, accurate, or error-free. In the event of a pricing or description error, we reserve the right to cancel or refuse any order, even after an order has been confirmed.

All offerings are subject to availability, and we may modify, discontinue, or limit any product or service at any time without liability.

4. Orders, Pricing, and Payment

All prices are listed in U.S. Dollars and are subject to change without notice. By placing an order, you agree to pay all charges, including applicable taxes and shipping fees.

Payment is processed through third-party payment processors (such as Squarespace Payments, Stripe, PayPal, Apple Pay, and Google Pay). By submitting payment information, you authorize us and our processors to charge the applicable amount. We do not store full payment card details on our servers.

We reserve the right to refuse or cancel any order for reasons including suspected fraud, errors, or unavailability.

5. Memberships and Subscriptions

Certain offerings may be provided on a recurring subscription or membership basis. By enrolling, you acknowledge and agree that:

  • Recurring billing: Your payment method will be automatically charged on a recurring basis (e.g., monthly or annually) until you cancel.

  • Renewal: Subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled before the renewal date.

  • Cancellation: You may cancel at any time through your account settings or by contacting studio@maggyelias.com. Cancellation stops future charges but does not retroactively refund amounts already paid, except where required by law.

  • Access: Upon cancellation, your access to membership content or benefits may continue until the end of the current paid period and then end.

We reserve the right to change membership pricing or benefits with reasonable advance notice.

6. Digital Content and Course License

When you purchase or access a course, e-book, or other digital content, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use that content for your own personal, non-commercial use.

You may not:

  • Copy, reproduce, distribute, resell, sublicense, or publicly share the content;

  • Record, screen-capture, or redistribute course materials;

  • Share account access or login credentials with others;

  • Use the content to create competing products or services.

Access to digital content may be subject to time limits as described at the point of purchase. We are not responsible for your inability to access content due to issues with your own device, software, or internet connection.

7. Shipping and Delivery

For physical products, estimated shipping times and costs are provided at checkout. Title and risk of loss for physical goods pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, or events outside our control. International orders may be subject to import duties, taxes, and fees, which are your responsibility.

8. Returns and Refunds

Our return and refund practices are described below. In general:

  • Physical products may be eligible for return within 30 days of delivery, provided they are unused and in original condition.

  • Digital products, courses, and memberships are generally non-refundable once access has been granted, except as required by law or as otherwise stated at the point of purchase.

9. Intellectual Property

All content on the Site, including text, teachings, writings, sermons, course materials, graphics, logos, images, designs, clothing collections, photographs, audio, and video, is the property of Maggy Elias or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not use, reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission, except for personal, non-commercial use as expressly permitted by these Terms.

The names, logos, and brand elements associated with Maggy Elias are trademarks and may not be used without written consent.

10. User Content

If you post reviews, comments, testimonials, or other content ("User Content"), you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with the Site and our marketing. You represent that you own or have the rights to any content you submit and that it does not violate the rights of others.

We reserve the right to remove any User Content at our discretion.

You agree not to:

  • Use the Site for any unlawful, harmful, or fraudulent purpose;

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY RESULTS WILL BE ACHIEVED FROM USE OF OUR CONTENT, COURSES, OR PRODUCTS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAGGY ELIAS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCTS OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
